Abstract

This study examines the contemporary juristic issues (nawāzil) arising in connection with the ritual stoning of the Jamarāt during Hajj. These issues have emerged from the growing number of pilgrims and from the architectural and organisational developments undertaken at the Jamarāt facility. To the researcher's knowledge, no independent study has previously treated them together. The study follows an inductive, analytical and comparative method: each issue is precisely delineated, the positions of the jurists are set out together with their evidence and the discussion surrounding them, and the strongest-supported view is then adopted. The study comprises an introductory section and four chapters. The introduction defines the stoning of the Jamarāt and explains its ruling and underlying wisdom. Chapter One covers the provision of pebbles to pilgrims: where they may be collected, whether they may be sold or given away, and whether they may be reused for stoning. Chapter Two covers the place of stoning, including stoning from the upper and lower levels and stoning Jamrat al-'Aqabah from behind. Chapter Three covers the enlargement of the pillar (shākhiṣ), the ruling on a pebble striking it, and the widening of the stoning basins. Chapter Four covers timing: the scheduling of stoning slots for pilgrim groups (tafwīj), and whether crowding permits the stoning to be brought forward, delayed, or combined.
The study finds that stoning from the upper and lower levels is permissible by analogy with stoning Jamrat al-'Aqabah from above; that enlarging the pillar (shākhiṣ) is permissible, while the original basin is, as a precaution, best left unenlarged; that scheduling pilgrim groups (tafwīj) is a permissible organisational measure and not a restriction on the legally prescribed time of stoning; and that delaying and combining the stoning is a general concession available to all pilgrims.
Keywords: Hajj nawāzil, stoning of the Jamarāt, Jamarāt pebbles, Jamarāt basins, pillar (shākhiṣ), pilgrim scheduling (tafwīj), crowding.
