السيرة النبوية وحجيتها في التشريع الإسلامي The Prophets biography and its authority in Islamic legislation د. عبد الحميد مجيد الشيش* د. عادل حسن أمين الحرازي** الملخص: اهتم المسلمون -منذ عصر الصحابة- بنقل جميع ما قاله -صلى الله عليه وسلم- وما فعله أو أقرّه، ونقلوا الأحداث والوقائع التي كانت في أيامه، فتشكّلت من هذه الروايات المنقولة (علم السيرة)، وتفرع عنه (الشمائل)، و(الخصائص) و(الدلائل) و(المغازي)، وقد اهتم بها جميعا علماء الحديث، رواية وتصنيفا ونقدا، ولم تكن هذه المرويات من السيرة مجرد قصص تورد للتسلية؛ بل كان لها كبير الأثر في الأحكام التشريعية، فالسيرة النبوية لها مكانتها وحجيتها بشكل عام، ولمرويات السيرة تأثير كبير في الأبواب التشريعية، فكان لهذه المرويات انعكاس على حياة الناس السلوكية، فهذا البحث يهدف إلى بيان الأبعاد المعرفية لهذا العلم وتفرعاته، ومواطن الالتقاء والتداخل بينها، والعلاقة بينها وبين الأبواب التشريعية، والأمثلة على تأثير مرويات السيرة في الأحكام التشريعية، واعتمد البحث على المنهج الوصفي والمنهج التحليلي المقارن، وخلص إلى جملة من النتائج أهمها: أن مرويات السيرة لم تكن بمعزل عن أبواب التشريع، بل هي جزء من الأحكام التشريعية، والأدلة على أن للسيرة حجة في التشريع كثيرة، ولأجل هذا فقد حرص علماء الحديث على نقل تلك المرويات لما له كبير الأثر على سلوك المسلم في جميع نواحي حياته. الكلمات المفتاحية: السيرة النبوية، حجية السيرة، الشمائل النبوية، الخصائص النبوية، الدلائل النبوية، أحاديث الأحكام. Abstract Since the time of the Companions, Muslims have been interested in transmitting all that the Prophet (peace and blessings of Allah be upon him) said From these transmitted narrations, the science of biography was formed, from which the science of shamail (shamail), shamail (characteristics), dalail (evidence), and mughazi (adventures) branched, all of which were taken care of by hadith scholars, narrated, classified, and criticized. These narrations were not just stories told for entertainment; they had a great impact on the legislative provisions, as the biography of the Prophet has its place and authority in general, and biographical narrations have a great impact on the legislative sections, so these narrations had a reflection on peoples behavioral life, this research aims to show the epistemological dimensions of this science and its branches, the areas of convergence and overlap, the relationship between them and the legislative sections, and examples of the impact of these narrations on the behavioral life of the people. The research relied on the descriptive approach and the comparative analytical approach, and concluded that the biographical narratives were not isolated from the legislative chapters, but are part of the legislative provisions, and the evidence that the biography has authority in the legislation is many, and for this reason the scholars of hadith were keen to transmit these narratives because of the great impact on Muslim behavior in all aspects of his life.
