عقود البناء والتشغيل ونقل الملكية (BOT) في البلديات السعودية: الإطار النظامي ودورها في تحقيق مستهدفات رؤية 2030م Build-Operate-Transfer (BOT) Contracts in Saudi Municipalities: Regulatory Framework and Their Role in Achieving Vision 2030 Objectives الباحث/ عبدالله بن إبراهيم بن سليمان القويفلي* الملخص يهدف هذا البحث إلى تحليل عقود البناء والتشغيل ونقل الملكية (BOT) كإحدى آليات الشراكة بين القطاعين العام والخاص، مع التركيز على تطبيقها في المشاريع البلدية بالمملكة العربية السعودية. وباستخدام المنهج التحليلي، يستعرض البحث الإطار النظامي لهذه العقود، ويحلل نماذج لمشاريع بلدية مطروحة بهذه الصيغة، ويربطها بمستهدفات رؤية المملكة 2030. وقد خلص البحث إلى أن تحقيق الأثر الإيجابي المحتمل لهذا النموذج التعاقدي، رغم وضوح إطاره النظامي، يتطلب تعزيز القدرات المؤسسية في البلديات وتطوير نماذج إجرائية موحدة لتحفيز الاستثمار وتحقيق أهداف جودة الحياة والاستدامة المالية. الكلمات المفتاحية: عقود البناء والتشغيل ونقل الملكية BOT، البلديات، رؤية المملكة 2030. Abstract This research aims to analyze Build-Operate-Transfer (BOT) contracts as a mechanism for Public-Private Partnership (PPP), with a focus on their application in municipal projects within the Kingdom of Saudi Arabia. Using an analytical methodology, the research examines the legal framework governing these contracts, analyzes models of proposed municipal projects under this formula, and links them to the objectives of Saudi Vision 2030. The research concludes that realizing the potential positive impact of this contractual model, despite the clarity of its legal framework, requires enhancing institutional capacities within municipalities and developing standardized procedural models to stimulate investment and achieve the goals of quality of life and financial sustainability.
