الجهات الإدارية المختصة بحماية أملاك الدولة العقارية Administrative Authorities Responsible for Protecting State-Owned Real Estate الباحث/ محمد صالح براهيم الحميد الملخص يهدف هذا البحث إلى بيان الجهات المختصة بحماية أملاك الدولة العقارية، وبيان سلطاتها، وتحليل الدور التنظيمي للهيئة العامة لعقارات الدولة في حماية أملاك الدولة العقارية، وبيان كيفية تكامل الجهات معها. واعتمد فيه الباحث على المنهج الوصفي التحليلي، وجاء البحث في ثلاثة مباحث: خصص المبحث الأول للحديث عن الهيئة العامة لعقارات الدولة نشأتها وتنظيمها واختصاصاتها التشريعية والإشرافية وصلاحياتها في التصرف في عقارات الدولة، والمبحث الثاني: لبيان تنظيم إدارات الممتلكات في الوزارات وفروعها واختصاصاتها الإشرافية والقانونية ومدى صلاحياتها، أما المبحث الثالث فتم التطرق فيه لصلاحيات إمارات المناطق الإدارية والإجرائية، ودورها في حماية أملاك الدولة العقارية. وتوصل البحث إلى نتائج منها: أن الجهات الإدارية المختصة بحماية أملاك الدولة العقارية نظاماً هي: الهيئة العامة لعقارات الدولة، واللجان الرئيسية في إمارات المناطق، وإدارات الأملاك في الوزارات والجهات وفروعها، وفي ديوان المحاسبة العامة، والهيئة الوطنية لمكافحة الفساد، كما توصل البحث إلى وجود تداخل في الصلاحيات والإجراءات بين الهيئة العامة لعقارات الدولة وبين بقية الجهات الإدارية في الإشراف والمتابعة وإدارة القضايا والتصدي لها، ويوصي الباحث بضرورة إصدار نظام إجرائي شامل للتصرف في أملاك الدولة العقارية يحدد أوجه التصرف وإجراءاتها، لحوكمة وضبط الإجراءات وتسهيل الرقابة والإشراف والمتابعة. الكلمات المفتاحية: الجهات الإدارية - أملاك الدولة -عقارات الدولة - حماية. Abstract This research aims to identify the competent authorities responsible for the protection of State Real Estate Assets, to delineate their powers, to analyze the regulatory role of the General Authority for State Properties (GASIP) in safeguarding these assets, and to articulate the mechanisms for integrating the functions of other entities with the Authority. The researcher adopted a descriptive-analytical methodology. The study is structured into three chapters: Chapter One: Dedicated to the General Authority for State Properties (GASIP), covering its establishment, organizational structure, legislative and supervisory jurisdictions, and its powers regarding the disposition of state real estate. Chapter Two: Explaining the organization of Property Directorates within ministries and their branches, their supervisory and legal jurisdictions, and the extent of their powers. Chapter Three: Exploring the administrative and procedural powers of the Regional Emirates (Amārat al-Manāṭiq) and their role in the protection of state real estate assets. The research yielded several key findings, including: The legally competent administrative authorities for the protection of state real estate assets are: the General Authority for State Properties, the main committees in the Regional Emirates, the Property Directorates within ministries and agencies and their branches, the General Auditing Bureau (GAB), and the National Anti-Corruption Commission (Nazaha). The study also found an overlap in powers and procedures between the General Authority for State Properties and other administrative entities concerning supervision, follow-up, case management, and response. The researcher recommends the necessity of issuing a comprehensive procedural system for the disposition of state real estate assets. This system should clearly define the methods and procedures for disposition to ensure governance, control over procedures, and to facilitate oversight, supervision, and follow-up.
