أثر القواعد الفقهية في تعزيز قيم الاعتدال والتسامح The impact of jurisprudential rules in promoting the values of moderation and tolerance د. حاتم بن حميد بن راشد الظاهري* *الأستاذ المشارك في قسم أصول الفقه الملخص هدف البحث: تهدف هذه الدراسة إلى بيان أثر القواعد الفقهية في تعزيز قيمتي الاعتدال والتسامح، وإبراز دورها في بناء منظومة قيمية تربوية واجتماعية مستقرة. منهجية البحث: اعتمد البحث على المنهج الاستقرائي لتتبع القواعد الفقهية الكبرى مثل: (الأمور بمقاصدها)، و(اليقين لا يزول بالشك)، و(المشقة تجلب التيسير)، و(لا ضرر ولا ضرار)، و(العادة محكمة). كما تم الاعتماد على المنهج التحليلي لدراسة علاقتها بالقيم التربوية، مع توظيف المنهج المقارن. أبرز النتائج: خلصت الدراسة إلى أن هذه القواعد لا تقتصر على تنظيم المعاملات اليومية، بل تمتد لتشكيل وعي فقهي يعزز ثقافة التسامح والاعتدال. كما أثبتت النتائج أن القواعد الفقهية تسهم بفاعلية في الحد من الغلو والتطرف، وتؤصل للقيم التربوية والاجتماعية التي تضمن مرونة الشريعة الإسلامية في معالجة التحديات المعاصرة.. الكلمات المفتاحية: القواعد الفقهية الكبرى؛ التطبيقات الفقهية؛ الوسطية والاعتدال؛ التسامح؛ التربية الإسلامية. Abstract Research Objective: This study aims to explore the impact of jurisprudential rules in promoting the values of moderation and tolerance، illustrating their role in building a stable educational and social value system. Research Methodology: The research adopted the inductive approach to trace major jurisprudential principles، namely: (Matters are judged by their objectives)، (Certainty is not overruled by doubt)، (Hardship brings about ease)، (No harm and no reciprocating harm)، and (Custom is a basis for judgment). It also employed the analytical approach to examine their relationship with educational values، alongside the comparative approach. Key Findings: The study concluded that these rules transcend regulating daily transactions; they extend to shape a jurisprudential awareness that enhances the culture of tolerance and moderation. The findings also proved that jurisprudential rules effectively contribute to reducing extremism، establishing educational and social values that ensure the flexibility of Islamic law in addressing contemporary challenges.
