حكم السب والشتم في الفقه الإسلامي والقانون اليمني The Ruling of Insulting and Cursing in Islamic Jurisprudence and Yemeni Law د / مبارك علي أحمد القطمي* الملخص هدف البحث إلى بيان الحكم الشرعي والقانوني من السب والشتم؛ وذلك في ضوء المنهج الاستقرائي والتحليلي، أي: تتبع أقوال الفقهاء وأدلتهم، ومن أجل ذلك قام الباحث بتقسيم هذه الدراسة إلى أربعة مباحث، تناول المبحث الأول منها، التعريف بمصطلحات البحث، وبين المبحث الثاني، الألفاظ التي يعاقب عليها، وأنواع التعزير؛ وتضمن المبحث الثالث، حكم السب والشتم فقهاً وقانوناً، وتحدث المبحث الرابع عن الحالات الاستثنائية للسب والشتم وعلاج الألفاظ الجارحة؛ فجاء البحث مكتملاً بأربعة مباحث وثمانية مطالب؛ وكان من أهم النتائج: التحذير والزجر من الشارع الحكيم للساب والشاتم، وتفعيل دور القضاء في ذلك، والتوصية بزيادة التوعية والتحذير من العواقب المترتبة على السب والشتم. الكلمات المفتاحية: السب ـ الشتم ـ التعزير ـ الألفاظ الشائعة. Abstract The research is aimed to clarify the Islamic and legal ruling of insulting and cursing in the light of the inductive and analytical approach through tracking the statements of religious scholars and their evidences. This study is divided into four sections; the first section deals with defining the research terms. The second section discusses words and utterances according to which the person can be punished، and the types of tazir. The third section includes the ruling of insulting and cursing in Islamic jurisprudence and Yemeni law. The fourth section talks about the exceptional cases of insulting and cursing and the treatment of hurtful words. The study arrives at the following recommendations: warning and restraining from the wise legislator to those who use insulting and cursing، activating the role of the judiciary in this concern، and raising awareness and warning of the consequences of insulting and cursing.
