In this study Sharh Mukhtasar Ibn al-Hajib by Imam Dawud ibn Ali al-Qaltawi al-Maliki (d. 902 AH/1496–97 CE) that covers the Book of Deposit and Loan for Use (Kitab al-Wadi’a wa-l-‘Ariya) Study and Verification.
This manuscript is one of the important commentaries in the Maliki school on Ibn al-Hajib’s Mukhtasar. The study aims to show the manuscript’s scholarly value, introduce its author, and explain his method of presenting legal issues. It also aims to produce a scholarly edition of the Book of Deposit and Loan for Use according to the established principles of manuscript editing.
The study uses the descriptive method to examine the author and the manuscript, and the applied method to edit the text. This involved selecting and verifying the base manuscript, documenting Quranic verses, tracing the sources of prophetic traditions (ahadith) and reports (athar), attributing quotations to their original sources, and commenting on terms and issues that need clarification. The study has two parts. Part One introduces the author and the work. Part Two presents the edited and corrected text of the Book of Deposit and Loan for Use from this manuscript.
The main findings are that the author was one of the most prominent scholars of his time, and that the manuscript has considerable legal value and contains distinctive quotations that show the author’s mastery of his own school and of the other schools. The researchers recommend further study of al-Qaltawi’s legal legacy and the editing and publication of his remaining works.
