تُعالج هذه الدراسة إشكاليةَ جبر الأضرار الناشئة عن أخطاء المنصات الحكومية الرقمية وحماية المستفيد منها؛ إذ لم يعُد التساؤلُ عن قيام مبدأ المسؤولية الإدارية — فهو مستقر — بل عن مدى كفاية منظومة التعويض القائمة لاستيعاب الأضرار الرقمية بأنواعها، ولا سيما الأضرار المعنوية والجماعية الواسعة الانتشار. وقد سلكت الدراسةُ المنهجَ الوصفي التحليلي المقارن بين النظام السعودي والقانونين الفرنسي والمصري، مؤصِّلةً الأساسَ الشرعي للمسؤولية. وانتهت إلى أن المنظومة السعودية — بالمواد (120) و(135) و(136) و(137) و(138) من نظام المعاملات المدنية — توفِّر أساسًا كافيًا لجبر الأضرار الفردية بصورتيها المادية والمعنوية، لكنها تقصُر عن مواجهة الأضرار الجماعية الرقمية؛ فاقترحت معيارَ «التوقُّع المشروع لمستوى الخدمة» ضابطًا للضرر غير العادي، ومنهجيةً موضوعية متعددة الأبعاد لتقدير الضرر المعنوي الرقمي، واستحداثَ الدعوى الجماعية الإدارية وفكرةِ «التعويض الوقائي» تعزيزًا لحماية المستفيد في البيئة الرقمية.

Abstract
Abstract
This study addresses the reparation of damages arising from errors in digital government platforms and the protection of the beneficiary. The question is no longer whether administrative liability applies — it is settled — but whether the existing compensation framework is adequate to capture digital damages in all their forms, particularly moral and large-scale collective harm. Adopting a comparative descriptive-analytical approach across the Saudi, French, and Egyptian systems, and grounding liability in Islamic jurisprudence, the study concludes that the Saudi framework — through Articles 120, 135, 136, 137, and 138 of the Civil Transactions Law — provides a sufficient basis for repairing individual material and moral damages, yet falls short before widespread collective digital harm. It proposes a legitimate service-level expectation criterion to delimit abnormal damage, an objective multi-dimensional methodology for assessing digital moral damage, and the introduction of an administrative class action and a preventive compensation mechanism to reinforce beneficiary protection in the digital environment.
