Jurisprudential Derivation between the Saudi Law and other Laws: A Comparative Study on some Issues of Divorce "Talaq" in the Personal Status Law

Abstract

This research aims to an attempt to bring the Saudi law closer to other different laws, which had a precedent for legalization, especially in the personal status laws. This demonstrates that the Saudi regulator (legislator) benefited from other laws and derived from them, especially in issues that concern a large group of people, such as issues of divorce (Talaq) in the personal status law, This is done through the comparative inductive analytical research method. It has been shown in the research that the Saudi regulator (legislator) benefited from all the advantages of these laws, even his words combined with each other, and this is what counts for him in this matter, The researcher recommends preparing legislative historical studies to clarify the issues and their historical development over time, so that we can come to know the advantages and avoid mistakes in this regard.
