Abstract

This study aimed to elucidate a condition unanimously agreed upon among scholars for those seeking permission to travel, which is the requirement of departure from the homeland. The study is structured into an introduction, three main sections, and a conclusion with recommendations. The introduction encompasses a preamble, review of previous studies, research questions, motivations for the study, and research methodology. The first section includes: defining travel according to jurisprudence, its permissibility, and the conditions for seeking permission. The second section discusses the necessity of departure from the homeland to initiate the permission process. The third section examines the application of juristic rulings on the boundaries of the Prophetic city in contemporary times, addressing the circumstances of leaving the city by various means of transportation. The research concludes with several findings, including: the consensus among scholars regarding the necessity of departure from the homeland, including inhabited areas and residences, as a condition for travel permission. The debate over the permissibility of seeking permission before departure is nuanced and supported with evidence and reasoning. Moreover, the research emphasizes that departure from the homeland alone is insufficient for permission; rather, all travel conditions must be fulfilled. Dr.Adel Bin Eid Alkhdede.
