Abstract

The current study aims to cover the important legal aspects related to the trademark. The study used the descriptive, analytical and comparative approach by analyzing Saudi legal texts, as the absence of the trademark or its use in a manner that violates the law may lead to the spread and circulation of counterfeit goods in the markets, which may cause material or moral harm to the consumer and the provider of the original product. Accordingly, this study addressed the protection of the trademark in the Saudi system, and showed that there are conditions that must be met for the trademark to enjoy this protection. It also showed the legal methods that can be resorted to to protect it, whether civil protection, criminal protection or precautionary means. The study reached a number of results, the most prominent of which is that the Saudi regulator has given great attention to the trademark and surrounded it with many means of protection due to its importance. This protection is one of the results of the legislative development that the Kingdom has witnessed due to the development in various commercial and economic fields in this field, and that the interest that the regulator sought from protecting the trademark includes both the trademark owner and the consumer. The current study also recommended.
