Abstract
The aim of this research is to introduce Imam Burhan al-Din al-Marghinani, highlight aspects of his personal life, list his juristic writings, explain their scholarly significance, clarify the jurisprudential differences between the books Nisab al-Fuqaha’, al-Muhit al-Burhani, and al-Dhakirah al-Burhaniyyah, and present the most important issues in which Nisab al-Fuqaha’ is distinct from al-Dhakirah fi al-Fatawa. The researcher employed the historical, inductive, and analytical methods. The main findings were: Imam al-Marghinani is Mahmud ibn Ahmad al-Bukhari, one of the leading Hanafi jurists, born in 551 AH into a prominent scholarly family in Bukhara, where he studied under leading scholars and emerged as an independent jurist. Among his most notable works are al-Muhit al-Burhani and Nisab al-Fuqaha’. Comparative analysis confirmed the independence of each book in terms of sources, structure, indexing, and number of books and chapters. Nisab al-Fuqaha’ is distinct in including fifteen books not found in al-Muhit, and it contains issues not mentioned therein, negating the notion that it is an abridgment. It also differs from Dhakirat al-Fatawa in structure and titles, affirming its identity as an original juristic work.
