Abstract

Abstract: The study examines the position of the international community regarding contemporary international disputes surrounding the Strait of Hormuz and the ways of addressing them. The research is divided into two main themes: the position of the international community toward contemporary international disputes concerning international straits, and future approaches to addressing contemporary international disputes related to international straits. The study discusses in detail the position of the littoral (coastal) states toward contemporary disputes surrounding the Strait of Hormuz, followed by the position of non-littoral states regarding these disputes. It also addresses future approaches to dealing with contemporary international disputes related to international straits. In this context, the research examines ensuring and protecting the rights and obligations of states in international straits, subjecting international straits to a special legal regime, and finally identifying and activating available alternatives to straits that constitute the subject of international disputes. The aim of the study is to identify the position of the international community toward contemporary international disputes surrounding the Strait of Hormuz and the mechanisms for addressing them. The researcher adopts the descriptive-analytical approach in conducting this study. The study reaches several findings, most notably that the absence of effective international mechanisms contributes to the escalation of disputes over international straits, and that the legal regime alone is insufficient to address contemporary disputes in international straits. The research also concludes that the littoral states of the Strait of Hormuz base their positions on considerations of sovereignty and security; however, some of these positions are inconsistent with the principle of freedom of navigation.
