Abstract

Praise be to God, Lord of the Worlds, and may blessings and peace be upon our Prophet Muhammad and his family and companions. Now then... This research is titled "Unemployment and its jurisprudential impact - a comparative study - as this study aims to explain the jurisprudential impact resulting from unemployment and study it as a comparative jurisprudential study, through issues that may have some kind of connection to this topic, I used the inductive method and the descriptive analytical method. This research included an introduction to explain what is meant by unemployment, its famous types, causes, effects, and methods of treatment, and four sections that dealt with the effect of unemployment on entitlement to zakat, its effect on theobligation of Hajj, as well as its effect on competence in marriage, and the extent to which left-handedness is considered a characteristic of competence, as well as its effect on The obligation of a relative to provide for his relative. The study concluded that unemployment is one of the reasons leading to poverty, and that those who are able to earn and work are prevented from asking for zakat, and that helping people with compulsory unemployment with money and giving them zakat is permissible only to the extent that helps them and what they improve in crafts and industries, and the like, and that the unemployed person Anyone who is unemployed, regardless of its type, is not obligated to perform Hajj and is not included in the ruling on someone who is able to perform Hajj. The study also addressed the impact of unemployment on the efficiency of marriage, how it affects the validity of the marriage, the role of custom in that, as well as the effect of unemployment on alimony and the difference in ruling on that, based on the difference in the obligation of alimony on descendants or assets, the condition of the spender and the recipient, and the difference in the type of unemployment.

The most prominent results of the research are the following: 1-Unemployment is one of the most important causes of poverty among individuals and societies. 2-Encouraging work and forcing it if necessary is one of the most important methods of treating unemployment. 3-Search for work, no matter how humble, without caring about people’s opinions. 4-It is permissible to pay zakat to the poor who are able to earn a living and work to the extent that helps them to work. 5-It is not permissible to pay zakat to a strong person who is able to earn a living and is willing to work. To prevent opening the door to unemployment, and to close the door to the issue that is forbidden by law. 6- Unemployment affects the obligation of Hajj. If someone does not have money and is unemployed, even if it is voluntary, the obligation of Hajj is waived from him until he is able to do so, and he is not burdened by the obligation and striving for it. 7-The unemployed person, whenever he is able to perform Hajj, whether by earning his living, even if it does not meet his basic needs, or if he is given money to perform Hajj with, is sufficient for the Hajj of Islam. 8- Unemployment has an impact on the ability to marry according to jurists, but the left condition, which is (financial competence), is due to people’s customs. Because stipulating it, even if it does not affect the validity of the marriage, it does affect the continuation of the marriage and its necessity, and the statement that it is considered sufficient is a restriction on those who want to marry. 9-The obligation of poor parents to provide for their well-off child, even if they are able to work and earn a living. 10-The support of a strong son who is able to work despite his absence (forced unemployment) must be paid by his wealthy father until he gets work and is independent of others. 11-A strong, earning son is not obligated to spend on his well-off father if he is able to work and abandons it out of laziness, so he is not obligated to spend on him. Likewise, if a daughter has an income that she can be self-sufficient, then she is not obligated to spend on her, unless the craft or work is not sufficient, in which case there is no objection to giving them in full. sufficiency; Because child support is based on consolation.
