Abstract
Abstract:
This study aims to examine the legal effects arising from convictions for corruption crimes committed during the performance stage of administrative contracts through a comparative analytical approach between Saudi law and Egyptian law. It addresses legal implications that extend beyond criminal sanctions to include contractual, administrative, and civil effects affecting public funds and the stability of public services. The importance of the study lies in focusing on a critical stage of administrative contracting, where contractual obligations are practically implemented and may be affected by forms of corruption such as bribery, fraud, and manipulation, resulting in complex legal consequences affecting the contract, the contractor, and the administrative authority.
The study adopts a comparative analytical methodology by examining relevant legal provisions in both Saudi and Egyptian systems, and identifying similarities and differences regarding principal, accessory, and complementary penalties, as well as contractual, administrative, and civil consequences of conviction. The study concludes that corruption convictions in administrative contracts are not limited to criminal penalties, but extend to contractual effects such as contract termination and guarantee confiscation, administrative effects such as debarment from future contracting, and civil liability for damages. It also highlights a clear divergence in regulatory approaches, with Saudi law granting the administration more direct and immediate powers, while Egyptian law relies more on procedural regulation and institutional mechanisms such as registers and administrative controls. The study recommends developing a clearer legal framework defining the relationship between criminal, administrative, and contractual sanctions to achieve a balance between protecting public funds and ensuring contractual stability.
